FHWA Updates Century-Old Rule Regarding Highway Projects

The U.S. Department of Transportation’s Federal Highway Administration (FHWA) has updated a federal rule that now gives states more flexibility when working with federally funded highway projects. This century-old rule restricted states from using patented or proprietary technology for highway projects. Now, the updated rule will allow states to be innovative and use state-of-the-art materials and products that best meet the needs of their federally funded highway projects.

This new rule will go into effect October 28, 2019.
